Participation in tenders and procurement
The main legal acts that regulate the field of public procurement in Vietnam are:
♦ Law “On Bidding” dated 26.11.2013 No. 43/2013/QH13;
♦ Decree “On detailing the implementation of several provisions of the Law on Bidding regarding the selection of contractors” dated 26.06.2014 No. 63/2014 / ND-CP;
♦ Decree “On guidelines for some articles on investor selection of the Law on Bidding” dated 17.03.2015 No. 30/2015 / ND-CP.
Viet Nam's public procurement legislation regulates national and international tenders.
There are the following requirements that must be met by contractors and investors:
♦ be registered in the country where the main operations are conducted;
♦ maintain independent financial statements;
♦ not be in the process of liquidation or bankruptcy;
♦ register as a participant of public procurement in the National Tender System (http://muasamcong.mpi.gov.vn/).
Tender announcements are published on the website of the National Tender System: http://muasamcong.mpi.gov.vn/, on the procurement portal of the Ministry of Planning and Investment of Vietnam: http://dauthau.mpi.gov.vn/ and in official Vietnamese newspapers for example at Dau Thau: https://www.dau-thau.com/.
